Terms of Service

These general terms apply to development, SEO, integration, and related services purchased from impik.dev. The specific scope, deliverables, timeline, and price for a given project are set out in a written Statement of Work (SOW) agreed with you before work begins. If a SOW says something different from this page, the SOW governs for that project.

Pricing is quoted per project after scoping, typically as a fixed price tied to the agreed SOW. Full prepayment is the preferred model; a 50/50 split is available if that suits you better, and larger projects can be divided into stages or sprints, each paid separately. Work on a given stage begins once payment for it has been confirmed as received. The exact payment method, currency, and any transfer fees are confirmed with you before an invoice is issued.

Work is demonstrated on a staging environment before it goes live. Acceptance is checked against the items agreed in the SOW — not against a subjective impression or the score of a third-party speed-test tool. The project moves to your own domain after acceptance and once the payment obligations for that stage are met.

For development and integration projects, defects against the agreed SOW are fixed free of charge for 30 days after launch. New features, changed requirements, and issues caused by third-party updates outside our control (platform, plugin, or API changes) are scoped and billed separately. Ongoing maintenance beyond this window is available as a separate, separately agreed retainer.

• Full custom UI/UX design isn't a standard part of development — projects are typically built from an already agreed layout, reference, or prototype; design work is available separately if needed.
• Pre-launch checks are a manual review of key pages, links, forms, and flows on desktop and mobile — not a full professional QA pass or an automated test suite.
• We don't guarantee a specific score on any third-party performance test, a specific search ranking, or a specific indexing timeline. None of these are fully within any agency's control, so they're never a deliverable or a condition of payment.

Once a project is delivered and paid for in full, ownership of the custom code and design created specifically for that project transfers to you. Reusable internal tools, frameworks, and components that impik.dev developed independently of your project, and any third-party software, plugins, libraries, or paid licenses used in it, remain governed by their own separate licenses and aren't included in that transfer.

To the extent permitted by law, impik.dev's liability for any claim relating to a project is limited to the amount paid for that project. impik.dev isn't liable for indirect, incidental, or consequential losses — such as lost profits, lost data, or lost business — arising from the use of a delivered project.

If either side needs to adjust scope, pause, or end a project before it's finished, how that's handled — including work already delivered and any partial refund — is agreed case by case and documented alongside the relevant SOW, rather than fixed by one formula here.

Both sides agree to keep the other's non-public business information confidential and use it only for the purposes of the project.

Projects commonly rely on third-party platforms — hosting, CMS, APIs, payment processors, analytics — chosen for or with you. impik.dev isn't responsible for the availability, pricing, or policy changes of those third-party providers.

The governing law and dispute-resolution process for a specific engagement are confirmed directly with you, in writing, before that engagement begins — this page doesn't fix one generally.
